TERMS AND CONDITIONS BANK OF COMMERCE CREDIT CARD E-STATEMENT Bank of Commerce Credit Card Electronic Statement of Account herein referred to as (“E-Statement”) is the electronic mailing service facility where the Cardholder can receive and view monthly Statement of Account thru an attachment delivered to a designated e-mail address (“Nominated Email”). The E- Statement contains information regarding Cardholder’s credit card account with Bank of Commerce (“Bank”). Unless the context otherwise requires, the use of words denoting the masculine meaning such as “he” and “his” shall include the feminine meaning. By signing up for and/or using the E-Statement, the Cardholder accepts and agrees to be bound by all operational rules and general terms and conditions governing the Bank of Commerce Credit Card E- Statement, including without limitation all the following paragraphs. The Cardholder further agrees to be bound by any and all laws, rules, regulations and official issuances applicable to the E-Statement and/or the facility, now existing or which may hereinafter be enacted, issued or enforced. The Cardholder agrees that the use of E-Statement constitutes his agreement to these terms and conditions as well as the acknowledgement of the inherent risks in the transmission of any and all E- Statement via email. ENROLLMENT. The Cardholder may enroll in E-Statement facility by providing a valid designated email address (“Nominated Email”) through Bank’s designated enrollment channel. The Bank shall have the absolute discretion, without giving any reason or notice, to reject any request for enrollment in the E- Statement facility. The Cardholder agrees that, upon enrollment in E-Statement facility, the Bank shall no longer deliver the paper form of monthly Statement of Account. Instead, the Bank will generate on the business day after the Cardholder’s designated statement date the electronic form of monthly Statement Account and make available or deliver the same, within seven (7) banking days after the statement date.The Cardholder agrees to accept and view the E-Statement online in a timely manner. The Cardholder also agrees that, by providing an email address to the Bank upon application or at any time after the Credit Card was issued, he is deemed enrolled in the E-Statement facility, unless the Cardholder cancels the enrollment. NOMINATED EMAIL ADDRESS. The Cardholder agrees and confirms that he is the owner and designated user of the email address provided during enrollment and as indicated in any designated enrollment form, and the Cardholder shall take all necessary security measures and precaution to ensure that the Nominated Email is not accessed by any unauthorized party. The Cardholder agrees and confirms that the Bank does not warrant the security and confidentiality of the E-Statement as well as the timeliness thereof in the transmission to the Nominated Email. The Cardholder agrees to immediately notify the Bank of any changes in his email address which has been registered to avail of the E-Statement. The Cardholder shall be solely responsible for the consequences of his inability to receive E-Statement as a result of his failure to timely notify the Bank of the change in email address. The Bank shall not be held liable in the event the E- Statement is received by wrong person, as a result of the Cardholder’s failure to timely notify the Bank of the change in email address. VIEWING THE E-STATEMENT. The Cardholder may view his E-Statement which is sent as an email attachment with the use of the E-Statement password. The Cardholder shall be responsible in reviewing the accuracy of the E-Statement. Any discrepancy or incorrect entry shall be reported by the Cardholder by calling the Bank’s Customer Care hotline at (02) 632 2265, within thirty days (30) from statement date. Moreover, the Cardholder shall report non-receipt of E-Statement within similar period, otherwise, the E-Statement shall be deemed delivered. The Bank shall not be liable in case the Cardholder is unable to view the E-Statement should the Cardholder enter the wrong password or when internet service is not available due to maintenance and/or computer, telecommunication, electrical, network failure or for any other reasons beyond the Bank’s control. WAIVER OF CONFIDENTIALITY. The Cardholder agrees and acknowledges that the transmission of E- Statement through the internet is not a secure communication and delivery system, and understands the risks associated with it (among others, breaches on confidentiality and security, tampering and unauthorized use). In view of this, the Cardholder agrees to waive his rights under Republic Act No. 1405 otherwise known as the Law on Secrecy of Bank Deposits, as amended, Republic Act No. 6426 otherwise known as the Foreign Currency Deposit Act of the Philippines, as amended, Section 55.1(b) of Republic Act No. 8791 otherwise known as the General Banking Law of 2000, their amendments and any and all other laws pertaining to the confidentiality of bank deposits now or hereinafter promulgated. The Cardholder hereby holds the Bank free and harmless from any claims that the Cardholder may have against the Bank, its directors, employees, representatives, agents and successors-in-interest, as provided by the above stated laws, arising from any damages that may incur from the availment of the E-Statement facility. SECURITY. The Cardholder agrees that the use and the transmission of information via email are not guaranteed to be secure and that the information transmitted may be corrupted due to software virus, unauthorized access or use. The Cardholder acknowledges that transmission may be disrupted, interrupted, intercepted or delayed. The Cardholder shall not hold the Bank liable for any losses or damages arising from or in connection with the use of the E-Statement facility by reason of software malfunction or virus as well as delay and/or non-transmission due to disruption, interruption, interception of mails and/or malfunction of any communication equipment or facilities. UNAUTHORIZED USE. The Cardholder agrees to take all steps necessary to prevent disclosure of password and un-authorized access of E-Statement, by any unauthorized person. SUSPENSION/CANCELLATION. The Bank shall have the absolute discretion to make the E-Statement available to Cardholders. The Bank reserves the right from time to time to modify, restrict, withdraw, cancel, suspend or discontinue the E-Statement facility without giving any reason therefor. The Cardholder understands that by using the E-Statement after any modification or change has been effected, he is deemed to have agreed to such modification or change. The Cardholder likewise shall have the right to cancel his enrollment in the E-Statement facility, provided that prior notice of such cancellation through electronic or paper document shall be sent to and acknowledged by the Bank or prior notice of such cancellation is made through the Bank’s Customer Care Hotline. Upon cancellation of enrollment, the Bank shall generate the paper form of Statement of Account beginning on the next statement date and send the same at the mailing address of the Cardholder based on Bank’s record. INDEMNIFICATION. The Cardholder shall hold the Bank free and harmless from, and agrees to indemnify and keep the Bank indemnified, against any and all proceedings, claims, losses, damages, or expenses (including legal costs) arising from or in connection with the following: (a) Bank’s action upon any instructions given through the communication channels mentioned in the preceding paragraph or upon instructions through Customer Care Hotline where Cardholder’s identity was established through the Bank’s verification process; (b) the improper or unauthorized use of E-Statement; (c) any damage to the Cardholder’s terminal (including mobile devices), related facilities or software as a result of access to E- Statement; (d) any loss or damage caused by the E- Statement or e-mail attachment when restricted or delayed or by reason of issuance of any law or regulation by any relevant government authority, internet service provider or information service provider affecting the use or component of the E-Statement, or brought about by system limitation; (e) any loss or damage caused by an act or omission of any relevant internet service provider or information service provider or network provider; (f) any loss or damage caused by modification, alteration, upgrade or termination of E- Statement; and (g) any delay or failure in transmission or dispatch or malfunction of communication facilities. AMENDMENTS. The Cardholder agrees that the Bank shall have the right to amend any of the above terms and conditions at any time by giving such notice in writing, whether by mail, facsimile or e-mail notification. AGREEMENT. The terms and conditions herein shall form part of the General Terms and Conditions governing the Bank of Commerce Credit Card.
