The Debit Card allows Cardholders worry-free access to his account/s thru any EMV compatible payment terminals, like ATMs and online merchants, here and abroad. āCardholder/sā means depositor or depositors of the Bank to whom a card has been issued. āEMVā means Europay Mastercard Visa. āMachineā or āATMā means Automated Teller Machine (ATM) installed by the Bank for use by the Cardholder. It also includes other ATMs or electronic devices in which the card could be used, as advertised from time to time. Debit Card Usage The Cardholder acknowledges that the card is for the exclusive use of the Cardholder and is the property of the Bank. The Cardholder shall in all circumstances assume full responsibility for all transactions processed by the use of the Debit Card whether these are with the Cardholderās knowledge or by his authority. Debit Card and Personal Identification Number (PIN) Release and Activation 3.1 The Debit Card and PIN shall only be released to the Cardholder. The Cardholder is required to change PIN immediately after receipt thereof and before doing any transaction using the Debit Card. 3.1.1 Any Debit Card that remains unclaimed after 30 days from notice to the Cardholder shall automatically be destructed by the branch of account. Replacement card shall be requested by the Cardholder should he decide to. 3.1.2 The Debit Card is deactivated upon its expiry as set by the Bank. Debit Card Ownership The Cardholder acknowledges that the Debit Card is and shall remain the property of the Bank. The Cardholder shall return the card to the Bank for cancellation in case the Cardholder no longer maintains the deposit covered by the Debit Card or the Account has been closed, or if the Debit Card is withdrawn by the Bank for any reason whatsoever. It is agreed and understood that the Bank has absolute discretion to withdraw the Debit Card and its services without prior notice to the Cardholder/s.The Cardholder also agrees that the Bank may also cause the ATM to retain the Debit Card automatically at any time without notice to the Cardholder. Applicable Rules and Regulations Debit Card service is a privilege granted to depositors in good standing with the Bank. All terms and conditions governing the Bankās current accounts and savings accounts shall likewise apply to the Debit Card. Moreover, the use of the Debit Card shall be subject to such regulations as may be imposed by the Bangko Sentral ng Pilipinas (BSP) from time to time relative to the establishment and operation of deposit accounts, as well as the rules and regulations of Mastercard and BancNet on the use of the Debit Card.In case of Joint OR accounts, each of the Cardholders shall be jointly and severally responsible for all transactions involving the use of the Debit Cards and these terms and conditions shall be jointly and severally binding on each and every one of them. International Access 6.1 Cardholder authorizes the Bank to debit from his Account the equivalent amount in Philippine currency of any withdrawal/payment made in currencies other than the currency of his Account, computed at prevailing exchange rate of the Bank at the time of the transaction. Such withdrawal/payment constitutes a disbursement from said Account in the Philippines and a remittance to the country where the withdrawal/payment transaction was effected, and shall, therefore be subject to the applicable laws, government rules and regulations of both the Philippines and the country where the withdrawal/payment transaction is made.6.2 Likewise, the Bank shall debit from the Cardholderās account the transaction fee/s Ā charged by the concerned merchants and ATM owner abroad computed based on prevailing exchange rate of the Bank at the time of the transaction. Security of the Debit Card 7.1 The care and security of the Debit Card is the sole responsibility of the Cardholder. The Cardholder hereby agrees to safeguard the Debit Card as if it were cash. 7.2 The Cardholder agrees to keep the PIN private and strictly confidential and agrees that these shall not be disclosed, given, or made available to any person under any circumstances. The Cardholder agrees to take all necessary precautions to avoid unauthorized use. The Cardholder agrees to free the Bank from any liability that results from disclosure of PIN. Payment of Bills Whenever authorized to be paid through the Bank, payment for bills shall be credited to the corresponding accounts of the merchants, only after the amount paid is verified in accordance with the internal procedures of the Bank. The amount verified shall be conclusively deemed to be the correct amount paid by the Cardholder.Discrepancies in amounts of payment shall be dealt with in accordance with procedures and regulations of the Bank.Payments are credited to the merchantās account on the date of transaction made by the Cardholder.8.1 The Cardholder agrees that the electronic receipt generated at the time the payment represents what the Cardholder purports to have paid and shall not be binding upon the Bank until verified.8.2 In accepting payment of bills, the Bank merely serves as a conduit between the Cardholder and the payee of the bill. The Bank shall not, therefore, be answerable for any discrepancy due to the fault of the Cardholder. Neither shall the Bank be held liable for any cause of action which may arise between the payee and the Cardholder in connection with bills payment, the latter hereby agrees to hold the Bank free and harmless from any such liability whatsoever. Transaction Limits and Restrictions 9.1 The Bank may, from time to time, impose a limit on the amount that can be transacted using the Debit Card regardless of sufficiency of balance of the Cardholder. ATM withdrawal shall be subject to the following conditions: a. minimum and maximum amount per withdrawal; and b. maximum withdrawal amount per day 9.2 Bills payment via ATM shall be subject to the account available balance. 9.3 Purchases via Point-of-Sale (POS) terminals and online shall be subject to the same ATM withdrawal limit of your Debit card. Purchases made using Mastercard contactless terminals requiring no PIN or signature shall likewise be subject to limit set by the Bank. 9.4 Transaction posting cut-off ā Transaction made on weekends or holidays shall be debited online to the account but posted as transaction of the next banking day. 9.5 Check deposits made on the Account shall be subject to the Terms and Conditions governing deposits.The Cardholder agrees that while the incoming clearing checks are being posted by the Bank, any simultaneous transaction done by the Cardholder thru the ATM shall have priority over the inward clearing items.Thus, the Bank may dishonor inward clearing checks that turn out to be overdrawn as a result of the simultaneous transaction made by the Cardholder. In this regard, the Cardholder also agrees that the Bank may collect service and penalty charges corresponding to the amount of the charges on returnable items as imposed by the Philippine Clearing House Corporation (PCHC) or the BSP. The Cardholder hereby holds the Bank free and harmless from any and all liabilities arising from dishonor of any check by reason of the foregoing provision. Lost/Stolen Debit Cards In case the Debit Card is lost or stolen, the Cardholder shall immediately notify the Bank through any means possible. The Cardholder shall likewise report any unauthorized transactions using the Debit Card.The Cardholder agrees that the Bank shall not be responsible for any unauthorized transactions prior to reporting and within 24 hours after the Bank is notified of such Loss.Lost Card may be replaced by applying for a new card from any Bank of Commerce Branch, subject to a specified fee charged to the Cardholder. Damaged or Defective Debit Card The Bank shall replace any damaged Debit Card (if previously used) or defective Debit Card (if never been used), subject to the surrender of the subject Debit Card, and provided that the same is not expired at the time of surrender. The Bank shall issue a replacement card for any damaged or defective Debit Card. Replacement of a damaged Debit Card shall be charged to the Cardholder, while replacement of defective Debit Card shall be at no cost to the Cardholder. Retention of Debit Card The Debit Card may be retained or captured by an ATM due to the following: Lost/Stolen Card; Defective Card; Transaction Time Out; and ATM Hardware/Machine failure Captured Cards shall be perforated if unclaimed by the Cardholder after the period of thirty (30) days Limitation of Liability The Cardholder agrees that the Bankās liability for any loss or damage that the Cardholder may incur from the issuance or use of the Debit Card, which is attributable to the fault or gross negligence of the Bank, shall in no case exceed the amount of Php10,000.00 or the actual damage, whichever is lower. The Bank shall not be liable for any special, consequential or indirect damage suffered by the Cardholder from the use of the Debit Card. Any claim or complaint relative to any Debit Card transaction under the provision of this paragraph must be presented within ten (10) calendar days from the date of such transaction; otherwise, it shall be deemed irrevocably waived. This provision shall survive the termination or suspension of the right to use the Debit Card. Cardholderās Complaints Any complaint regarding the Debit Card or its use, or both, shall be communicated immediately to Bank of Commerce through any possible means. If the Bank deems it necessary, the Bank will conduct an investigation on the complaint for its prompt resolution and communicate its findings to the Cardholder. The Cardholder agrees to fully cooperate with any such investigation by providing necessary or required data, information, and documents. Cost and Venue of Suit In case the Bank is compelled to litigate by reason of the Cardholder’s use of the Debit Card, the Cardholder shall pay the costs and expenses of litigation and attorneyās fees equivalent to twenty percent (20%) of the amount involved in any case not less than Ten Thousand Pesos (Php10,000.00). Any legal action in connection herewith shall be filed only in the proper court of Mandaluyong City, Metro Manila. Separability of ProvisionsShould any of the stipulations herein be held invalid, the legality and enforceability of the remaining stipulations shall not in any way be affected or impaired. Notices Unless otherwise provided herein, any and all notices and communications required or allowed to be given herein shall be in writing and sent to the Cardholder at the address indicated in his application form. Notices shall be deemed received by the Cardholder on the date of receipt, if delivered personally, after five (5) days from posting, if sent by mail, or on the date of transmission, if by facsimile or electronic mail. The Cardholder shall immediately notify the Bank of any change in his address, as well as any information indicated in his application form. Until receipt of such notice, the Bank shall continue to use such information and data contained in said application form. Disclosure of Information The Cardholder expressly agrees to the disclosure by the Bank, as it deems fit, any and all information about the Cardholder or his Debit Card transactions to its partners, agents, service providers, related companies, affiliates and subsidiaries as well as to other creditors, banks, financial institutions, and/or any government regulatory agency, without the Bank or its related company, incurring liability as a consequence thereof. Change of Terms and Conditions The Bank reserves the Ā right to amend at anytime any of the terms and conditions herein stated as it may deem necessary for the best interest of the Bank and Cardholders, provided such additions, alterations and amendments are not contrary to banking laws and regulations of the BSP, or the By-Laws of the Bank.The amended terms and conditions, rules and regulations arising therefrom shall be communicated to the Cardholder Ā by posting notice of such amendment in any conspicuous place at the office of the Bank where this Debit Card service account is maintained, publishing the same in the Bankās website or in such other form or manner determined by the Bank. Acceptance of Terms and Conditions By using the Debit Card, the Cardholder is understood to have read and accepted the above conditions and other additional regulations as the Bank may subsequently prescribe from time to time covering the account.The Cardholder expressly agrees that the use of the Debit Card is at his own risk and shall assume all risks or delays to or arising out of the use of the Debit Card. Terms and Conditions Governing Deposits In all matters concerning the Debit Card, the Cardholder or his account that are not covered by this Debit Card herein, the Bankās Terms and Conditions Governing Deposits shall apply. Safety Tips The new Bank of Commerce Debit Card is issued with a unique card number and 6-digit Personal Identification Number (PIN). Ā For security, all new cards are issued unactivated and must go through the Bankās activation process before they can be used. Ā Upon receiving your new Debit Card and once it has been activated, you must change your PIN immediately thru any Bank of Commerce ATM and sign at the back of the card. Keeping your PIN and Debit Card details safe and confidential will protect you from fraudulent Debit Card cash withdrawals.
